Terms of Use

Preamble

These General Terms of Use (hereinafter "Terms") are intended to define the conditions under which users (hereinafter "the User" or "Users") may access and use the website and application Ranki (hereinafter "the Service" or "the Platform"), accessible at https://www.ranki.fun.

The Service is published by Opexa SAS, a simplified joint-stock company with capital of €2,000.00, registered in the Trade and Companies Register of Paris under number 102 882 503, whose registered office is located at 59 rue de Ponthieu - Office 326, 75008 Paris, France (hereinafter "Ranki", "the Publisher", "we" or "our").

Access to and use of the Service are subject to full and complete acceptance of these Terms. By creating an Account or using the Service, the User acknowledges having read, understood and accepted without reservation these Terms, which constitute a legally binding contract between the User and Opexa SAS.

These Terms are supplemented by the Privacy Policy and, where applicable, by the General Terms of Sale for paid offers.

Article 1 — Definitions

In these Terms, the following terms, whether used in the singular or plural, have the meaning attributed to them below:

• « User »: Any natural person who has created an Account on the Platform, whether acting as a consumer, non-professional or professional
• « Account »: Personal and secure space of the User, created upon registration, allowing them to access the Service features after authentication
• « Organization »: Legal entity or entity (company, association, collective, group) that administers a dedicated space on the Platform, bringing together Users around prediction competitions
• « Organization Administrator »: User with extended administrative rights over an Organization (member management, competition settings, moderation)
• « Competition »: Structured set of sporting events on which Users of the same Organization can submit Predictions
• « Prediction »: Prediction formulated by a User on the result of a match or sporting event, recorded on the Platform
• « Points »: Virtual units, devoid of any monetary value, awarded to Users based on the accuracy of their Predictions according to the defined scale
• « Badge »: Virtual honorific distinction awarded to a User in recognition of their performance or active participation
• « User Content »: Any content published by a User on the Platform, including Predictions, chat messages, comments, profile photos and any other element

Article 2 — Purpose and description of the Service

2.1 Nature of the Service

Ranki is a sports prediction platform with a playful and community character allowing Users to:

• Create a free personal account and join one or more Organizations
• Make predictions on the results of matches and sporting events
• Accumulate virtual Points based on the accuracy of their predictions
• View individual and team rankings within their Organization
• Obtain Badges and virtual rewards
• Interact with other members of their Organization via the chat feature
• Access statistics on their performance and that of their Organization

2.3 Access to the Service

The Service is accessible 24 hours a day, 7 days a week, subject to interruptions for maintenance, updates, or in case of force majeure. Access to the Service requires an internet connection, the costs of which remain the responsibility of the User.

Article 3 — Account registration and management

3.1 Registration conditions

To create an Account on the Platform, the User must imperatively:

• Be a natural person aged at least 16 years old, or be at least 13 years old with express authorization from their legal representative (parent or guardian)
• Have the legal capacity to enter into these Terms
• Provide accurate, complete and up-to-date identification information
• Have a valid and functional email address
• Accept without reservation these Terms and the Privacy Policy

3.2 Registration process

Registration for the Service can be done according to the following methods:

• Direct registration: Via a registration form with email address and password
• Third-party authentication: Via a third-party authentication service (Google, etc.), subject to the User's acceptance of sharing certain data with Ranki
• Invitation: Via an invitation link sent by an Organization Administrator

Registration is free and provides access to the basic features of the Service. Advanced features may be available as part of paid offers governed by the General Terms of Sale.

3.3 Account security and confidentiality

The User is solely responsible for maintaining the confidentiality of their login credentials (email address and password). They undertake to:

• Choose a sufficiently strong password and not reuse it on other services
• Never disclose their credentials to third parties, including other members of their Organization
• Immediately inform Ranki, by email at contact@opexa.eu, in case of unauthorized use of their Account or any breach of its security

Any connection and any action taken from a User's Account will be deemed to have been taken by that User. Ranki cannot be held responsible for any loss or damage resulting from the User's failure to comply with their security obligations.

3.4 Accuracy of information

The User undertakes to keep their personal information accurate and up to date. In case of modification, the User must update their information from their Account settings without delay.

Article 4 — Rules for using the Service

4.1 General obligations

The User undertakes to use the Service in a fair, reasonable manner and in accordance with these Terms, applicable laws and regulations, and the rights of third parties. The User is prohibited from:

• Creating multiple Accounts for the same natural person
• Impersonating a third party or using a false identity
• Providing false information during registration or use of the Service
• Using automated means (robots, scripts, crawlers, third-party software) to interact with the Platform without prior written authorization from Ranki
• Attempting to manipulate rankings, results or the Points attribution system by any means
• Collecting, storing or exploiting personal data of other Users
• Disseminating User Content that is unlawful, offensive, defamatory, insulting, obscene, pornographic, discriminatory, inciting hatred, violence or contrary to good morals and public order
• Transmitting viruses, malicious code or any element likely to harm the functioning of the Service
• Attempting to circumvent technical security measures or access Ranki's computer systems without authorization
• Impairing, in any way, the proper technical functioning of the Platform

4.2 Rules relating to Predictions

Predictions are subject to the following rules:

• Predictions must be submitted before the start time of the match or sporting event in question. No Prediction can be created or modified after kickoff
• Points are calculated and awarded automatically by the Platform after the end of the event, according to the scale defined by the Organization or the default rules of the Platform
• Rankings are updated in real time and reflect the cumulative Points obtained by each User
• In case of cancellation, postponement or modification of a sporting event, Ranki reserves the right to cancel the corresponding Predictions or adapt the Points attribution rules
